MEDIATION

Mediation is a service that helps people deal with any or all of the issues that can arise when family relationships have broken down and which may otherwise result in Court proceedings. Such a crisis could be a couple considering separation or divorce, achieving a fair and reasonable financial settlement, or other family members who maybe anxious about future contact arrangements with children. Mediation provides the opportunity to resolve family disputes in a thoughtful and co-operative way, resulting in proposals for settlement that more fully addresses your own personal situation.

A Mediator can assist you to communicate with each other about future arrangements in a positive way.

Mediation is recommended by the Legal Services Commission as a first step towards resolving family disputes to avoid seeking the intervention of the Court. A legally aided client should attend a first information session with a family mediator before embarking on any Court proceedings which may require extension of their legal aid funding. However progressing to a full mediation remains a voluntary process.

Mediation is now actively encouraged by the Court and most Judges will strongly emphasise the need to consider family mediation to improve communication between parents.

Most people are referred to mediation through their family lawyer although many participants make enquiries direct. If you would like further information about BLJ Mediation you must ask at the outset and not have sought legal advice from this firm. There must be “no conflict of interest

Participants in mediation are encouraged to seek independent legal advice since it is helpful for all parties to come to mediation on equal terms and be informed as to their legal rights and responsibilities.

If you wish for further information about the mediation process please do not hesitate to contact our mediation department direct on 08444 124 348 and ask for Pat or Pam at The Cotton Exchange.
